Title: Some Clarification on the Opinion Regarding Zaka'h Question: I would like you to clarify some of your views on Zakat. In your view, women's jewelry, which are worn generally, are not subject to Zakah. But Imam Abu Hanifah, Ibn Hazm were of the view that it is obligatory to pay zakah on worn jewelry. You also wrote that there is no Zakah on trade goods. But majority of past scholars, were of the opinion, that the Zakah should be paid on trade goods. Are there Zakah on Plants and fruits, vegetables? What is the nisaab for Plants and Fruits? Could you please explain the basis of your opinions, which are contrary to major jurists? Answer: My answers to your questions follow: The Hanafites and Ibn Hazam generalize the directive of the Prophet (pbuh) regarding Zaka'h on gold and silver and apply it to all kinds of jewelry as well. However, in our opinion, the directive of the Prophet (pbuh) relating to Zaka'h on gold and silver, applies only to that gold and silver which is not otherwise excepted from Zaka'h . Furthermore, it may also be noted that on the basis of the principle that items in one's regular personal use are exempted from Zaka'h , only that jewelry would be exempted from Zaka'h that is worn on, more or less, a regular basis. It is not my opinion that there is no Zaka'h on traded goods. If I have written anything to that effect, it would only be a mistake. I will be grateful if you point it out to me so I can make the required corrections. Zaka'h will be levied on all kinds of agricultural and industrial production, except that which the government may like to exempt for the purpose of promoting it. I hope this helps.
