Question
Title: Remarriage with one's Ex-wife Question: A salaam ualeikum! I am married to a man who divorced his ex-wife when he fell in love with me. Now we are married and he has been divorced from his ex-wife for a year. Now he wants to remarry her coz they have a child together. He wants to have her as a second wife. But he cant afford to support me. So I want him to first support me before I accept a second wife. I work fulltime and live alone visit my husband some days a week. What shall I do? Should I leave him to his ex-wife and child? Must I accept a second wife even that he cant support me first? I am very sad and I want my husband to take care of me first, is this correct? I love him very much and he loves me too very much. He wants me to stay with him. But I am thinking about leaving them to each other even if this would break my heart.. wa aleikum salaam Sahara Sweden Answer: It is not clear from your question whether your husband has the right of remarriage with his ex-wife? This is because the Shari`ah does not allow a person to remarry his ex-wife if he has used his right of divorce with that wife three times. If, however, he has used his right of divorce once or twice only [1] , then he has the right of remarriage. Your question does not clarify the situation from this perspective. If a third divorce had been pronounced then the matter is not complicated, as, in that case, the marriage between your husband and his previous wife is not allowed. On the contrary, if your husband has not used his right of divorce three times, then, in my opinion, the concern of looking after his child is a sufficient reason of remarriage with his ex-wife. Just think of yourself as being in her position: assume that you have a child and you have been deserted alone, what would be your feelings? What would be your requirements and demands? I think in this case it would be your utter desire that your child be cared and looked after by his father and you, yourself, would be in need of company as well. Suppose you are stable financially, even then, leaving aside the other human requirements, you would be feeling the need of someone to accompany you. The Shari`ah does not prohibit a second wife, provided the person is able to fulfill the requirements of apparent justice between his wives. Your demand is genuine that your husband should support you. It is his indeed his duty to do so. Try to convince him morally and remind him about his responsibilities. Ask yourself sincerely that whether you still love him, if the answer is positive then my suggestion is you should sacrifice not only for the sake of your love but for the child also. I would not recommend your leaving him, it is quite possible that you dislike something but there is some hidden benefit for you in it. The holy Qur'an says: فعسى أن تكرهوا شيئا ويجعل الله فيه خيرا كثيرا (النساء 4: 19 ) Thus, it is possible that you dislike something, while God creates extreme good in it. Moreover, it seems that the advantage of leaving your husband would be much less than that of enduring and tolerating the second wife, provided, of course, that the law of the land in which you reside allows your husband to keep more than one wives at one time.
