Question

Title: Regarding missed part of Sala'h Question: A person while offering Sala'h , stands after two rak`ats without sitting for Tashahud . Now he should sit for Tashahud or continue his prayer? Muhammad Abeer Answer: Before reading on with my answer to your question, it is important to understand that my opinion may not correspond with that of some other Muslim scholars. In such cases, where there exists a difference of opinion, the opinion of the Imam (i.e. the person leading the prayers) should be followed. In my opinion, if a person mistakenly stands up after the second Rak`at , rather than sitting down for the Tashahhud and is reminded of his mistake immediately, then he should sit down for his Tashahhud and, thereby, correct his mistake. Subsequently, before offering Salaam to mark the end of his prayers, he should offer Sajdah-e-Sahaw , as a recompense for his mistake. If, on the contrary, the person is reminded of his mistake only after having recited the Faatihah or a part of the Surah , then he should continue his prayer till the end. In this case, as in the first, I would recommend the offering of Sajdah-e-Sahaw before the final Salaam . Some scholars because of their opinion that the Qiyaam is a Fard (obligatory) portion of Sala'h , while the Tashahhud is a Sunnah , therefore, in case a person mistakenly stands up for Qiyaam after the second Rak`at , without sitting down for Tashahhud , he should still continue praying till the end. He should not interrupt the Qiyaam - which is an obligatory part of Sala'h - for the Tashahhud - which, in their opinion, is a Sunnah part of Sala'h, and, therefore, entails a lesser significance.
