Question

Title: Divorced by My Wife Question: My newly married wife has sent me devorce letter declaring permanent devorce (Talak-e-Bayen) using the power giving by me in the marriage registration paper during the marriage contract. Although I knew the law during the marriage, but ignore it thinking it unnecessary. Because I never imagine that, this power will be really used. Now have I any way to return my wife? Please explain the Law of "Ikhtiar". Is a man can withdraw the devorce power from his wife after giving the power? Even when the wife use the power and declare to devorce, then what is the condition of that devorce? Is it revocable or irrevocable? If revocable, is it depend on the opinion of both of them, or anyone of them can cancel it? Answer: Abiding by the contract is incumbent upon you: it is the command of God: Allah will not impose blame upon you for what is meaningless in your oaths, but He will impose blame upon you for [breaking] what you intended of oaths. - Al Ma'idah 5:89 And fulfill the covenant of Allah when you have taken it, [O believers], and do not break oaths after their confirmation while you have made Allah, over you, a witness. Indeed, Allah knows what you do. - Al Nahl 16.91 Unfortunately there seems to be an issue in which your wife has chosen to dissolve the marriage and only if she chooses to reconcile the matter may you return to one another. You cannot compel your wife to do anything against her will. Moreover, you have no legal right to withdraw any divorce powers from her. Thus, if she has decided on an annulment you should not breach the contract; doing so may result in grave consequences when Judgment arrives. The only way that the divorce can be revoked is that both of you agree to the terms. If she decides she no longer wants a divorce and you still would like to be with her then things should work out fine. In the future, be more careful in your oaths and contracts. Your wisdom in relation to such matters should be at its sharpest. Remember God in all that you do and take into consideration the following: And those who respect their trusts and covenants; And those who stand firm in their testimonies; And those who guard (the sacredness) of their worship; - Such will be the honoured ones in the Gardens (of Bliss). - Al Maarij 70:32-35 I hope I have clarified the issue.
