Title: What Shall be the Status of the Marriage if a Muslim Woman Marries a non-Muslim Man Question/Comments: A friend of mine who is a Mulsim woman is intending to marry a non-Muslim man [who does not subscribe to any religion but believes strongly that there is only one God] via civil marriage. Since in your earlier answers to this subject matter is that it has not been explicitly allowed, will this mean that the marriage can be considered null/void in respect of Islam and will God then strongly diapproves this union? Salaam Answer: As I had stated in my earlier response, the Shari`ah does not expressly prohibit or allow marriage between a Muslim woman and a Christian or a Jewish man. Due to this reason, it is difficult to say that God "strongly disapproves this union". Obviously, those who consider the silence of the Qur'an to imply a disapproval, would be of the opinion that God does not approve of this union, while those who do not consider the silence of the Qur'an to imply a disapproval would not consider such marriage to be disapproved by God. It should, however, remain clear that marriage between a Muslim man or a woman with a person ascribing to polytheism ( shirk ) is expressly prohibited by Islam. Nevertheless, even if such marriage is considered to be against the directives of the Shari`ah . it should NOT be considered as "null/void". On the contrary, it should be considered as a legal social contract which should be called-off, in view of the fact that it is not approved by the Shari`ah . This really implies that such a man and a woman should separate through 'divorce' rather than considering the marriage contract to be 'null/void'. I hope this helps. Regards
