Title: A Further Exchange on the Proof of Qiyas Question/Comments: In your response to my question about qiyas and the proof of it from the Quran and Sunnah, you said that Qiyas was a common sense principle that the ulema derived to be able to deduce fiqh issues. Another question I have regarding this issue: does qiyas produce certainty? Also, are there any issues that the shariah just doesnt cover? fi amaanillah. Answer: Considering that Qiyas is a function of the human mind it can only produce mortal replies to questions. Being a matter related to human understanding and application, Qiyas does not produce certainty, in general. Matters relating to human understanding, application and interpretation are communicated on the basis of reason and logic. If this reason and logic is found to agreeable, they can be held as correct. While if the reason and logic is not found to be agreeable, one may disagree with such interpretation and understanding. Thus, the question of certainty does not arise in such matters. Nevertheless, as long as the person is satisfied with the validity of his Qiyas , he should continue to act accordingly. Human societies are an evolving phenomena. Thus, there can obviously be such newly evolved issues, which were not directly or, even indirectly, covered by the Shari`ah . I hope I have clarified the issue. God knows best.
